Lahv+ Privacy Policy

Introduction

We are ankaEK Pvt. Ltd., operator of the LAHV+ Platform (“LAHV+ Platform”, “we” or “us”). This privacy policy explains how we process (i.e., collect, store, use, disclose, and protect) the personal data that you provide to us via the LAHV+ Platform, mobile application, website, application programming interfaces (APIs), QR workflows, and related services and features (collectively, the “Services”). Our Services are meant only for users 16 and older. We reserve the right to request proof of age, via a verified identification method, at any stage so that we can verify that anyone less than 16 years of age is not using our Services.

Providing personal data to us signifies your consent to our processing of your personal data in accordance with this privacy policy and Nepal’s privacy laws and regulations including the Privacy Act, 2075 (2018). For purposes of this privacy policy, “personal data” means information that can identify an individual directly or through other reasonably available means, including name, image (which may be in photos or videos), address, motor vehicle information, parking history, and payment information. We will use and disclose your personal data in order to provide and improve our Services, send you information about the Services and products and services offered by third parties, as well as to make advertising available to you both via our Platform and elsewhere.

The choice to provide us with personal data is always yours. Upon your request, we will explain your options of refusing or withdrawing consent to the processing of your information, and we will record and comply with your written choices. Your decision to withhold particular details may limit the Services we are able to offer to you. For example, if you do not allow us to collect your credit card information, we may not be able to offer payment processing. Please take the time to read this policy in full, and if you do not agree with its terms, please do not access or otherwise use our Services.

Please note that your personal data is processed in our secure servers in Nepal and is not exported outside of Nepal.

What do we use your personal data for?

We process your personal data only for the following reasons:

  • Operate Services — To operate and maintain our Services, administer user account, and send you Services-related updates.
  • Processing Transactions — To set-up accounts and to process transactions for parking operations and parking enforcement.
  • Customer Service — To respond to your requests and inquiries and train our employees.
  • Feedback — To solicit your feedback and improve our Services.
  • Marketing — To send you recommendations, personalize our marketing activities, and conduct market research.
  • Advisors — To provide information to representatives and advisors, including lawyers and accountants to meet our legal and accounting needs.
  • Protecting our Legitimate Interests — To protect and enforce the rights and interests of our employees, users, suppliers, affiliates, business partners, and our own rights and interests, and to take any action in case of legal dispute.
  • Information Security and Fraud Prevention — To prevent and remediate fraud, misappropriation, infringements, violations, identity theft, cyber-attacks and other security incidents, illegal activities and misuse or abuse of the Service and to detect, prevent and address fraud, security or other technical issues.
  • Compliance — To comply with the law, court orders and warrants, and assist law enforcement agencies to prevent fraud, infringements, identity thefts and any other misuse of the Services.

Types of information we collect

We collect personal data by fair and lawful means and limit collection to that information which is necessary for the purposes identified in this Privacy Policy. The type of personal data that we may ask for includes:

  • Information about your identity such as your full name, date of birth, gender, username and password, address, contact information including email address and telephone number, and data in any photographs or videos or audio recordings that you upload onto our Platform.
  • Motor vehicle information including license plate number.
  • Credit card or other payment information.
  • Device-specific information (such as your hardware model, operating system version, unique device identifiers, and mobile network information).
  • Log information such as Internet protocol address, device event information such as crashes, system activity, hardware settings, browser type, browser language, the date and time of your request and referral URL.
  • Location information such as GPS signals sent by a mobile device.

Occasionally, we may ask you to update your consent to ensure that our files remain accurate and up-to-date. We recommend that you inform us of any relevant changes to your personal data by emailing us at info@lahvplus.com.

Data collection by third parties

We also use third-party Software Development Kits (SDKs), such as Geolocator GPS to locate nearest available parking spots, mobile scanner to scan QR codes, and Dio network library to allow internet connections. These SDKs may collect user data and transmit it to their servers. We ensure that our partners adhere to high privacy standards and comply with privacy regulations. You may opt out of SDKs via your device settings. Note that if you opt out, some of our Services may not function optimally.

Disclosure to third parties

We do not sell or rent your personal data to third parties. However, some of the personal data may be shared, only on need basis, with the parking lot operators, payment processors, or third party service providers in order to provide the Services.

In some instances, such as a legal proceeding or court order, we may also be required to disclose your personal data to government authorities. We take precautions to satisfy ourselves that the authorities that are making the disclosure request have legitimate grounds to do so. Your personal data may be disclosed in situations where we are legally permitted to do so, such as in the course of employing reasonable and legal methods to enforce your or our rights or to investigate suspicion of unlawful activities.

Keeping your information accurate

We make every reasonable effort to keep your personal data as accurate, complete and up-to-date as necessary. Despite our best efforts, errors sometimes do occur. Should you identify any incorrect or out-of-date information in your account, we will timely remedy any such errors. Please contact us at info@lahvplus.com to rectify or update any personal data.

How long do we retain personal data for

We retain different types of personal data for different periods depending on its purpose, our legitimate business purposes, and pursuant to applicable legal requirements. For example, we will maintain your account information (such as username and password) until such time as you notify us, in writing, that you no longer wish to use the Services. We will maintain your contact details to help us stay in contact with you. At any time, you can contact us to delete your contact information after which we will delete your personal data within 30 days. We will retain your personal data after you have terminated your use of the Services if retention is reasonably necessary to prevent fraud and abuse and misuse of data.

Cookies

We use various technologies to collect and store data, and this may include sending one or more cookies or similar type of tracking technologies (such as beacons, pixel tags, etc.) to your device. The use of cookies allows us to capture standard web traffic information, such as the time and date you visited our Services, your IP address, and your browser information. You can set your browser to accept all cookies, reject all cookies, or notify you when a cookie is set. However, if you set your browser to disable all cookies, some features of the Services may not function properly.

Protecting your personal data

We endeavour to safeguard your information by maintaining appropriate and robust physical, technological, and administrative security measures, systems and procedures designed to protect information against unauthorized access, damage, loss, disclosure, alteration, or destruction. For example, we restrict access to users’ personal data only to limited personnel and we use industry-standard encryption technology to process your payments. These measures provide sound industry standard security. However, no method is 100% secure. Our security practices are reviewed on a regular basis, and we strive to use measures that we reasonably believe will keep your personal data safe.

Your privacy rights and how to exercise them

You have control over how we process your personal data. For example, you have the right to the erasure/deletion of your personal data that we have collected. To delete your personal data, at any time, you may delete your account and uninstall the LAHV+ Platform. In the event that you delete your account and the App or request erasure of your personal data, we will remove your personal data within 30 days; however, we may not be able to delete some of your personal data to the extent that it is still required for discharging our legal obligations.

  • Right to know and access. The right to know what personal data has been processed about you. You can request a copy of the personal data related to you that we store about you.
  • Rectification. The right to correct inaccurate or incomplete personal data maintained about you.
  • Deletion. The right to request deletion/erasure of personal data processed about you and terminate your account.
  • Opt-Out of sharing. The right to opt-out of the processing of personal data related to you, or otherwise the use of such data for targeted advertising or profiling.
  • No discrimination. The right to not be treated in a discriminatory manner for exercising your privacy rights.

Updates to this privacy policy

From time to time, we may update this privacy policy, which shall be effective immediately. Your continued use of our Services following such updates or changes constitutes your acceptance of the changes. Therefore, please periodically review this policy for any updates or change.

Services governed by this policy

Our Services are governed by the provisions in this privacy policy. Our Services may contain links to third-party sites that are not governed by this privacy policy. Although we endeavour to only link to sites that share our commitment to your privacy, please be aware that this policy will no longer apply once you leave our Services and that we are not responsible for the privacy practices of third-party sites. We therefore suggest that you closely examine the respective privacy policies of third-party websites to learn how they collect, use and disclose your personal data.

Governing law

This privacy policy and all related matters are governed by the laws of Nepal.
